Although discussed in March 1999 it has not yet been adopted. This is partly due to the complex discussions ... also partly due to acknowledged "negative" media coverage The delay in adopting the revised "Requirements" has not stopped EU member states, like the UK, ameding their interception of telecommunications laws to include the "Requirements"

Various delegations (B/D/F/NL/S/UK) expressed misgivings about the implications of the Directive, in particular Article 6, where it is stated that "traffic data relating to subscribers and users processed for the purpose of the transmission of a communication and stored by the provider of a public communications network or service must be erased or made anonymous upon completion of the transmission."

This "Council Resolution on law enforcement operational needs with respect to public telecommunication networks and services" to integrate the surveillance internet and wireless data networks never made it to legal validity. The attempt to update the 1995 resolution on "lawful interception" failed, because Germany did not agree. Exact reasons yet in the dark.

The Presidency provided information on the state of play...It recalled the negative press that this issue has received in the media...Against this background, the Presidency thus recognised that progress in this matter is being very slow. ...Several delegations expressed some caution as regards the preparation of a press release, noting that this could provoke a chain reaction and further negative press in the media. The Commission, whilst noting that its position has not changed, informed delegations that a possible way to break the deadlock could be following a similar strategy as that followed in tackling the issue of Child Pornography in the Internet. Although acknowledging that this was a different topic it also has an interception dimension."

This document, a predecessor of ENFOPOL 55 [June 2001] was published first by statewatch.org, a civil rights database we highly recommend. ENFOPOL 29 [March 2001] is the effort to adaptate the 1995 EU Council decision on according to the "international user requirements" formulated in the US-dominated ILETs and then in the EU Council Police Cooperation Working Group.
